What is a Court of Bankruptcy Document?

There are several key documents the British Court of Bankruptcy issues that may be requested by other parties.

These include:

  • Petitions filed by a creditor or the debtor themselves.
  • A Bankruptcy Order, which officially declares the debtor bankrupt.
  • A Certificate of Discharge, confirming a person is no longer bankrupt.

When Do You Need Notarisation or Legalisation For a Court of Bankruptcy Document?

You may need to notarise a document from the Court of Bankruptcy if it is requested by someone in another country. This might be a government organisation, an insurer, or a private company. 

The recipient might also request a standardised form of legalisation called an apostille. This is a certificate we can obtain for you from the FCDO (Foreign, Commonwealth and Development Office).

How Was Your Court of Bankruptcy Document Issued?

The steps required for notarisation and legalisation will depend on how your document was issued:

  • An original Court of Bankruptcy document stamped or sealed by the court, or signed by an official of the court

This doesn’t need notarisation and can be apostilled directly by the FCDO.  However, if you did need it notarised, the notary can verify either the original or a copy.  

  • An original Court of Bankruptcy document not stamped, sealed or signed by a court, or an official of the court

This needs notarisation. The notary will need to contact the court to verify they issued it, and can then notarise the original or a true copy of the original. After it has been notarised, we can submit it to be apostilled. 

  • A printout of your electronic Court of Bankruptcy document produced from the original PDF or other electronic document.

This requires notarisation first. We will need to verify where you logged in to download it from.  Once notarised, we can submit it to the FCDO to be apostilled.  

Can You E-Notarise and E-Apostille a Court of Bankruptcy Document?

Yes, we can e-notarise a copy of your Court of Bankruptcy document and submit it to the FCDO for an e-apostille.

Please note that an e-apostille is only available as a PDF file, and there will be no physical copy. You should always check with the ultimate recipient of the document as to whether they will accept an e-apostille document.

Process for Notarising a Court of Bankruptcy Document
